Customer Conduct Policy
Adopted by the Devine City Council, April 19, 2005

The Driscoll Public Library facilities are available to persons of all ages. While everyone has an equal right to access library services and facilities, no person has the right to interfere with the ability of others to use and enjoy library resources, services, and facilities.

To make sure that everyone enjoys using the library, the following rules have been established and adopted by the Devine City Council.

The Library Director and authorized staff are responsible for enforcing customer conduct in the library and on library premises. Anyone found to be interfering with another’s use and enjoyment of the library will be asked to stop the behavior or activity. If the behavior continues, the staff will ask the individual to leave the library. Failure to leave will result in staff calling the police for assistance.

To provide an enjoyable library experience for everyone, no person shall:

  • Possess or display weapons, including concealed handguns.
  • Possess alcohol or any illegal substance or be intoxicated (whether by alcohol or other mind altering drugs) to the point of impairment of his/her mental or physical abilities.
  • Exhibit disruptive, uncontrolled behavior or exceed acceptable noise levels.
  • Verbally abuse library customers or library staff.
  • Harass customers or staff, or attempt to engage customers or staff in unwanted discussion.
  • Bring animals into the library, except for guide dogs/animals that accompany and assist persons who are physically challenged.
  • Enter the library without shoes and shirts.
  • Use a skateboard, scooter or skate in the library or on library premises.
  • Present bodily hygiene that is distracting to customers or staff to the point that it interferes with customers’ use of library resources or with staff work.
  • Make unauthorized or inappropriate use of library equipment (e.g. computers, emergency exit doors, etc.).
  • Destroy or deface library resources or property or the personal property of customers or staff.
  • Steal library property.
  • Trespass into any area closed to the public.
  • Eat or drink in public areas, unless authorized by library personnel.
  • Place briefcases, book-bags, musical instruments, etc. where they block aisles or take up workspace of customers and staff.
  • Sleep in the library.
  • Smoke in any area of the library.
  • Use cell phones to receive or make phone calls while in the library.
  • Leave children aged eight years old, or younger, unattended.


Unattended Children Policy
Adopted by the Devine City Council, April 19, 2005

The Driscoll Public Library welcomes use by children, and staff will assist them in use of Library materials or services.

For the child's safety and comfort:

  • Children 8 and under must be under the supervision of a parent or caregiver at all times when visiting the library.
  • Children 4 and under must be in a direct “line of sight” with a parent or caregiver at all times.
  • Children 9 and older may be left unattended in the library for a reasonable period (not to exceed approximately 2 hours) to read, complete homework, or work on special projects. Children under 12 may not use the computers if left unattended. Unattended children should have a reliable way to contact the parent or guardian.

Library staff will notify the parent or guardian of unattended children when:

  • it is possible that the Library will be closing earlier than usual (due to inclement weather, a power outage, etc.).
  • the child's behavior disturbs other users of the Library.
  • there is cause to believe that the child's health or safety is in danger.
  • the Library staff is unable to provide the necessary degree of supervision that is desirable for young children, for extended periods of time.

Library staff will not transport children to another location under any circumstances. The Devine Police Department will be called in the event that any child is left unattended in the library at closing time.


Internet Policy Agreement Form

Internet computers will not be used for illegal activity, to access illegal materials, or to access materials which by local community standards would be obscene. Library employees are authorized to take prompt and appropriate actions to enforce the Rules of Conduct, and/or to prohibit use by persons who fail to comply with the Internet Acceptable Use Policy as stated or implied herein.

Users must sign up to use the Internet on a next-available-terminal basis. Terminals will not be "reserved" for persons who are not in the immediate vicinity when their name is called, and telephone reservations will not be taken.

Access will be limited to one sixty-minute session per day, unless otherwise authorized by the Librarian in Charge.

Installation, downloading, or modification of software is prohibited.

Users will respect copyright laws and licensing agreements.

Users will not make any attempt to gain unauthorized access to restricted files or networks, or to damage or modify computer equipment or software.

Library staff may limit use of computer equipment which has been purchased from grant funds, according to the terms or intent of the grant agreement.

Users will respect the privacy of other users, and will refrain from attempting to view or read material being used by others.

By mutual agreement, two persons may share one access session as long as their behavior or conversation does not disturb other users or Library staff.

User is responsible for all printing charges. It is advisable for users to use Print Preview feature prior to final print selection. Prompt payment by users who incur charges for printing or other authorized fees is required.

Children 11 years and under are required to be supervised by a parent or responsible adult (18 years or older).

Use of profanity, aggressive behavior, and/or loud talking will be grounds for immediate termination of session.

Users must end their session and leave the terminal when asked to do so by authorized Library staff.

As with other Library materials, parents and legal guardians who are concerned about their children's use of the Internet should provide guidance to their own children and should monitor their use of this resource. Only you have the right to define what material or information is consistent with your personal and family beliefs, and only you can apply these values for yourself and your children as you use the Library's resources.

Patrons have the right of confidentiality and the right of privacy. Users should be advised, however, that because security is technically difficult to achieve and computers are located in public areas, electronic transactions of files and viewing screens could become public. As a result, the Library cannot guarantee privacy or confidentiality.

Library employees are authorized to terminate any user’s access session, or to prohibit a user from subsequent access sessions if given cause to believe that the user has failed to comply with the Internet Acceptable Use Policy and/or Rules.

Internet users whose access session has been terminated and/or prohibited may appeal the action to the Devine City Council at the regularly scheduled sessions on the third Tuesday of each month. Appeals must be submitted in writing. Contact the City Offices at 830-663-2993 for details.
